WHAT IS CONTRACT?

Contract is a fundamental aspect of civil law that governs the formation, interpretation, and enforcement of agreements between parties.

  3. Enforcement of Contracts: Contract enforcement involves ensuring that parties fulfill their obligations under the terms of the contract. If one party fails to perform as promised (breach of contract), the other party may seek legal remedies to enforce the contract. Remedies for breach of contract may include monetary damages, specific performance (compelling performance of the contract), rescission (cancellation of the contract), or restitution (restoring parties to their pre-contractual positions).
  4. Types of Contracts: Contract law covers various types of contracts, including bilateral contracts (where both parties exchange promises), unilateral contracts (where one party makes a promise in exchange for an act), express contracts (explicitly stated terms), and implied contracts (implied by the conduct of the parties). Additionally, contracts may be categorized as sales contracts, service contracts, employment contracts, lease agreements, and more, each with its own legal principles and requirements.
  5. Defenses to Contract Enforcement: Certain legal defenses may excuse parties from performing their contractual obligations or render a contract unenforceable. Common defenses include mistake, duress, undue influence, fraud, unconscionability, illegality, and lack of capacity.
